Agreement to These Terms

These Terms of Service govern your access to and use of August, a product of Fermat Commerce, Inc. By accessing the August website, joining the waitlist, or using August as an approved user, you agree to these Terms.

Eligibility and Accounts

August is intended for business and professional use. You must provide accurate account information and keep your credentials secure. Access to the August application may be limited to approved users and organizations.

Acceptable Use

• Do not use August in violation of law or third-party rights.
• Do not attempt to disrupt, reverse engineer, or bypass security.
• Do not submit unlawful, harmful, infringing, deceptive, or abusive content.
• Do not use August to make decisions that require human judgment or regulated professional advice without appropriate review.

Submitted Content

You are responsible for prompts, images, Figma links, research goals, focus group stimuli, and other content you submit to August. You grant Fermat Commerce the rights needed to host, process, display, and use submitted content to provide and improve August.

AI Outputs

August uses AI to generate digital twin conversations, focus group responses, summaries, and related outputs. AI outputs may be inaccurate, incomplete, or not representative of actual customer behavior. You are responsible for reviewing outputs before relying on them.

Third-Party Services

August may integrate with or rely on third-party services, including authentication, hosting, analytics, email, Figma, and AI model providers. Your use of those services may also be subject to their own terms and policies.

Ownership

Fermat Commerce and its licensors own August, including its software, design, models, workflows, and related intellectual property. Except for rights expressly granted in these Terms, no rights are transferred to you.

Feedback

If you provide feedback or suggestions about August, Fermat Commerce may use them without restriction or obligation to you.

Disclaimers

August is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Fermat Commerce disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Fermat Commerce will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising out of or relating to August.

Suspension and Termination

We may suspend or terminate access to August if we believe your use violates these Terms, creates risk, or may harm August, Fermat Commerce, users, or third parties.

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required by law. Continued use of August after changes become effective means you accept the updated Terms.
